Terms of Service

By accessing or using ClapDiet (“the Service”) you agree to be bound by these Terms of Service (“the Terms”) and by all applicable laws and regulations. If you do not agree with any part of them, you may not use or access the Service. The Terms apply to every visitor and user of the Service.

2. Description of the Service

ClapDiet is a nutrition tracking and food recommendation platform that provides:

• Access to a database of more than 6,000,000 foods — 4,000,000 unique entries after deduplication — with nutrition information
• Personalized food recommendations based on your health conditions
• Lab result analysis and interpretation
• Meal tracking and nutrition logging
• Tools for managing health conditions

When you create an account you must give us accurate, complete and current information. You are responsible for:

• Keeping your account credentials confidential
• Everything that happens under your account
• Telling us immediately about any unauthorized access
• Keeping your account information accurate and up to date

You must be at least 13 years old to use the Service. By using it, you confirm that you are.

4. Use Licence

Subject to these Terms, ClapDiet grants you a limited, non-exclusive, non-transferable and revocable licence to:

• Access and use the Service for personal, non-commercial purposes
• Download and use the mobile app on your own devices

Under this licence you may NOT:

• Modify, copy, or create derivative works of the Service
• Reverse engineer, decompile, or disassemble any of the software
• Use the Service for any commercial purpose without our authorization
• Attempt to gain unauthorized access to any part of the Service
• Use automated means to access the Service or to collect data from it
• Interfere with or disrupt the integrity of the Service

The nutrition information, food recommendations and health insights that ClapDiet provides are for educational and informational purposes only. This information:

• Is not intended as medical advice, diagnosis, or treatment
• Must not replace a consultation with a qualified healthcare provider
• May not be appropriate for your individual circumstances
• Should be checked with a healthcare professional before you make any health decision

Always seek the advice of your doctor or another qualified health provider with any question you have about a medical condition or a change of diet. Never disregard professional medical advice, or delay seeking it, because of something you have read on ClapDiet.

6. Your Content

You keep ownership of everything you submit to the Service, including lab results, health data and feedback. By submitting content you grant ClapDiet a non-exclusive, worldwide, royalty-free licence to use, store and process it for the purpose of providing and improving the Service.

You confirm that you have the right to submit the content you provide and that it infringes no third party’s rights and breaks no applicable law.

Your use of ClapDiet is also governed by our Privacy Policy, which describes how we collect, use and protect your personal information. Please read it to understand what we do with your data.

8. Intellectual Property

The Service and its original content (excluding your own content), its features and its functionality are and remain the exclusive property of ClapDiet and its licensors. The Service is protected by copyright, trademark and other laws. Our trademarks and trade dress may not be used without our prior written consent.

9. Limitation of Liability

To the maximum extent permitted by law:

• ClapDiet is not liable for any indirect, incidental, special, consequential or punitive damages
• ClapDiet is not liable for any loss of profit, data, use, goodwill or other intangible loss
• Our total liability will not exceed the amount you have paid ClapDiet in the preceding 12 months

Some jurisdictions do not allow certain warranties to be excluded or liability to be limited, so some of the limitations above may not apply to you.

10. Indemnification

You agree to defend, indemnify and hold harmless ClapDiet and its officers, directors, employees and agents against any claim, liability, damage, loss or expense arising out of, or in any way connected with, your access to or use of the Service, your breach of these Terms, or your violation of any third-party right.

11. Termination

We may terminate or suspend your account and your access to the Service immediately, without prior notice and without liability, for any reason, including:

• Breach of these Terms
• Violation of applicable laws or regulations
• Conduct we judge to be harmful to other users or to ClapDiet

On termination your right to use the Service ends immediately. You may request deletion of your data in accordance with our Privacy Policy.

We may modify or replace these Terms at any time. Where a revision is material we will give at least 30 days’ notice before the new terms take effect; what counts as material is determined at our sole discretion. By continuing to use the Service after a revision takes effect, you agree to be bound by the revised terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or from the Service will be resolved in the courts of Delaware.

14. Severability

If any provision of these Terms is held unenforceable or invalid, it will be changed and interpreted so as to accomplish its objective as far as applicable law allows, and the remaining provisions will continue in full force and effect.
